Terms of Service

1. About these terms
These Terms of Service ("Terms") govern your use of FestWave at festwave.app, operated by Joel Perrenoud, Alte Forchstrasse 16, 8126 Zumikon, Switzerland ("FestWave", "we", "us"). By using the site or buying access, you agree to these Terms.
2. What FestWave does
FestWave is a personalised festival-planning tool. You provide your own music taste — by uploading a library you have exported yourself (for example via Exportify) or by selecting artists — and FestWave matches it, in your browser, against a festival's published line-up to show you which acts you may like and when and where they play. You can also view a festival's schedule without providing any taste data.
3. Independence — no affiliation
FestWave is an independent tool. We are not affiliated with, endorsed by, sponsored by, or an official tool of any music festival, venue, artist, record label, or of Spotify or any other streaming service. Festival names, artist names, and logos are the property of their respective owners and are used only descriptively to identify publicly known events and performers. We present line-up and schedule information as factual event data.
4. Access (no accounts)
FestWave does not require you to create an account. Access to content you have unlocked is remembered in your browser. A monthly subscription is associated with the email address you provide at checkout so we can recognise your active subscription.
5. Purchases, pricing and delivery
- Single festival: a one-time fee of EUR 2.90 unlocks one festival.
- Unlimited monthly: a recurring subscription of EUR 3.90 per month unlocks all available festivals while active.
- Prices are shown in euros. FestWave is not registered for Swiss VAT (turnover is below the CHF 100,000 threshold), so no Swiss VAT is charged. For customers in the European Union, applicable VAT may be added at checkout based on your country of residence.
- Payments are processed by Stripe; we never handle your card details.
- Instant digital delivery: access is delivered immediately on successful payment. By purchasing, you request and agree to this immediate delivery.
6. Accuracy of festival data — important
Line-ups, set times, and stage information are compiled from public and community sources and from official festival material. They are provisional and may change, sometimes at short notice. We make reasonable efforts to verify the data but do not guarantee its accuracy or completeness. Always confirm set times in the festival's own official app or programme. We are not liable for any act you miss or any reliance on schedule data.
7. Acceptable use
You may use FestWave for your own personal, non-commercial planning. You must not: copy, scrape, resell, or redistribute our festival data or content; attempt to bypass payment or access controls; or reverse-engineer, disrupt, or misuse the service.
8. Intellectual property
The FestWave name, site, software, design, and the compilation and curation of our festival data are our property or licensed to us, and are protected by law. Third-party names and marks remain the property of their owners (see section 3).
9. Disclaimers and limitation of liability
The service is provided "as is" and "as available". To the fullest extent permitted by Swiss law, we exclude implied warranties and are not liable for indirect or consequential loss, or for loss arising from inaccurate schedule data or service interruptions. Nothing in these Terms limits liability that cannot be excluded under Swiss law (including for unlawful intent or gross negligence).
10. Subscriptions and cancellation
You may cancel your monthly subscription at any time; cancellation takes effect at the end of the current paid period, and you keep access until then. See our Refund Policy for how payments are handled.
11. Refunds
Purchases are subject to our Refund Policy, which forms part of these Terms.
12. Changes
We may update the service and these Terms. Material changes will be posted on this page with a new "last updated" date. Continued use after changes means you accept the updated Terms.
13. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zürich, Switzerland, subject to any mandatory consumer-protection provisions in your favour.
